1.Prices

All prices listed are in EURO. If VAT is required, this is included in the listed price.

2. Delivery

When you buy an upgrade, a licence code will be sent to the email address you provided. Normally this will be done within 48 hours. If we don’t send you your licence code within 7 days, you have the right to apply for a refund and you will receive your licence code for free.

3. Ownership

The content of this website, including trademarks, logos, drawings, data, product or company names, texts, images etc., is protected by intellectual property rights and belongs to Sylvester Solutions.

Downloading a free version of the software or buying an upgrade licence gives you no ownership of the software or any rights to Sylvester Solutions.

Sylvester Solutions grants you the non-exclusive use (storing, loading, installing or executing) of the executable version of the software. You are not allowed to modify any software, disable the licensing features, decompile, reverse engineer or decrypt the software.

You are not entitled to sell or otherwise transfer any licence in whole or in part.

4. No warranties

All software and related documentation is provided by the copyright holders and contributors “as is” and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. Any and all risk that might arise out of the use of the software stays with the user.

5. Liability

The liability of Sylvester Solutions for direct damages shall never exceed the licence fee, if any, paid by you directly to us.

6. Right of withdrawal / Refund policy

We firmly believe in our software, however we know that it is not possible to test the software in combination with all the different boards available. In table you can find an overview of all the Arduino boards we have tested in our test factory.

All software from Sylvester Solutions has a free version for you to download and test. Before purchasing any upgrades, you should try the free version to see no problems arise.

If you buy an upgrade and it is not to your satisfaction and you would like a refund, please contact us within 14 days of buying the upgrade. A refund can be granted under one of the following conditions:

• “Does not work as documented” = The software (grave derogation) does not behave as indicated in the documentation and as a result it is totally unsuitable for your use.
• “Unfit for your use” = You intended to use our software for a certain use but it turns out wrong and you were unable to establish this before the purchase based on the available documentation, website and other sources.
• “Product verification assistance” = The board you use is not part of our test factory, (indicated C / Vx.y on the table) and you support us in testing this board.

Refunds will be given at our sole discretion. Our decision will be based on the case you bring, and as we are focusing on the customer experience, in case of doubt from our side, you will get the advantage.  By purchasing an upgrade from Sylvester Solutions you agree with this refund policy and relinquish any rights to subject it to legal action. We are not liable to cover any differences in exchange rates between the time you purchased the upgrade and the time you are refunded.

7. Licensing

All licenses are per computer and unlimited in time. Each license is linked to a computer motherboard and HD. You have the right to move your license 3 times. Contact info@sylvestersolutions.com if you want to move your license.

Licenses remain valid for new software releases (minor upgrades). Eg if you bought a license from WawiLib 1.2.7, the license is valid for WawiLib 1.5.1 (all versions 1.x.y).

8. Validity

If any provision of these Terms and Conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by Sylvester Solutions to enforce or exercise any of the rights listed in these Terms and Conditions shall never be considered a waiver of such provision and shall never affect the validity of these rights.

9. Applicable law – Disputes

Belgian law is applicable. For any legal disputes, only the courts of the registered office of Sylvester Solutions have jurisdiction.
